WEG administration: what the administrator does and what the community decides

Since the reform of the German Condominium Act (Wohnungseigentumsgesetz, WEG) on 1 December 2020, the division of roles in a community of owners has been more clearly defined. Knowing who is responsible for what saves a lot of trouble – for owners, the advisory board and the administration alike.

The community is responsible for the administration

The administration of the common property is the responsibility of the community of condominium owners (§ 18 WEG). It decides by resolution in the owners' meeting (Eigentümerversammlung). The administrator is its body: he carries out the resolutions, handles day-to-day tasks and represents the community externally (§ 9b WEG), for example towards tradespeople, utilities and authorities.

What the administrator may do without a resolution

Under § 27 WEG, the administrator may and must take measures of proper administration that are of minor importance and do not lead to significant obligations, as well as measures needed to meet a deadline or avert a disadvantage. Typical examples are minor repairs, calling the emergency service after a burst pipe or replacing a defective bulb in the stairwell. What exactly counts as "minor" depends on the size of the property. The owners can extend or restrict the administrator's powers by resolution – which creates clarity for both sides.

The core commercial tasks

  • Budget (Wirtschaftsplan): For each calendar year a budget is drawn up, on the basis of which the owners resolve the advance payments (Hausgeld) (§ 28 Abs. 1 WEG).
  • Annual statement (Jahresabrechnung): After the end of the year, the administrator prepares a statement on the budget. The owners resolve additional payments or an adjustment of the advance payments (§ 28 Abs. 2 WEG).
  • Asset report (Vermögensbericht): It shows the balance of the maintenance reserve and the community's main assets (§ 28 Abs. 4 WEG).
  • Accounting and bank accounts: collecting Hausgeld, making payments, dunning
  • Collection of resolutions (Beschluss-Sammlung): All resolutions are documented continuously (§ 24 Abs. 7 and 8 WEG).

The technical tasks

Administration also means keeping an eye on the building: regular inspections, maintenance contracts for heating, lifts or smoke detectors, obtaining quotes and checking commissioned work. For larger maintenance measures, the administrator prepares draft resolutions for the owners to decide on at the meeting.

Owners' meeting and advisory board

The owners' meeting takes place at least once a year (§ 24 Abs. 1 WEG). The budget, the annual statement and larger measures are resolved there. The advisory board (Verwaltungsbeirat, § 29 WEG) supports and monitors the administrator. It should review the budget and annual statement and add its opinion before the meeting decides. An active, well-informed advisory board is an asset to any community.

What owners can do themselves

  • Read invitations and draft resolutions before the meeting and ask questions in advance
  • Pay Hausgeld on time – the community's ability to pay depends on it
  • Report damage to common property promptly
  • If you let your flat: inform tenants about the house rules
