Dismissal is possible at any time
The owners can dismiss the administrator at any time by resolution (§ 26 Abs. 3 WEG). An important reason is no longer required. The administrator contract ends no later than six months after dismissal. If it expires earlier anyway, it ends at that time. A simple majority of the votes cast at a properly convened meeting is sufficient.
Step by step to the change
- Take stock: When does the current contract end? What is not going well, and what should the new administration do differently?
- Obtain quotes: Request several quotes. For a sensible choice, the community should usually have several quotes to compare.
- Compare quotes: What is included in the basic fee and what costs extra? How is availability arranged? Is there a fixed contact person?
- Prepare the meeting: The dismissal of the old and appointment of the new administration, as well as the authorisation to sign the administrator contract, belong on the agenda. If the current administration is not willing to convene the meeting, the advisory board can do so under certain conditions.
- Pass the resolution and sign the new administrator contract, usually through an authorised person such as the chair of the advisory board.
- Organise the handover: plan the cut-off date, the switch of bank accounts and the handover of documents.
What the old administration must hand over
The previous administration must hand over all documents it has kept for the community. These include:
- declaration of division (Teilungserklärung), community regulations, collection of resolutions and minutes
- budgets, annual statements, asset reports and accounts
- bank statements, bank mandates and the documents on the maintenance reserve
- contracts with service providers and utilities, insurance policies and open claims
- plans, maintenance records, keys and locking plans
- open matters: court proceedings, dunning proceedings, current orders
You will find a complete list in our checklist for changing administrators.
The right time
Many communities change at the turn of the year. This has an advantage: the old administration prepares the statement for its last full year, and the new one starts with a new financial year. A change during the year is also possible. In that case, the handover report should clearly state who prepares which statement.
Certified administrator
Since 1 December 2023, every condominium owner can demand that a certified administrator be appointed (§ 19 Abs. 2 Nr. 6 and § 26a WEG). Exceptions apply to small communities with fewer than nine units if an owner is the administrator and not at least one third of the owners demand a certified administrator. Ask for proof when you obtain quotes.
How we can help
Corpus Hausverwaltung supports communities through the change: with a written quote that you can present to the meeting, with help preparing the resolution and with a structured takeover of the documents. We will notify you in writing of anything missing from the handover.
